These Website Terms of Use (the “Terms”) govern your access to and use of susanwfoundation.org and any other website, page, or online feature that links to these Terms (collectively, the “Site”). The Site is operated by the Susan Wojcicki Foundation (“Foundation,” “we,” “our,” or “us”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
Additional terms, notices, consents, or disclosures may apply to specific programs, services, events, research activities, grant opportunities, donation campaigns, or other features that the Foundation may offer. If additional terms apply, they will be provided in connection with the relevant program, service, or feature
1. Purpose of the Site
The Site is intended to provide information about the Foundation, its mission, charitable activities, events, donor communications, and related updates. The Site may also allow visitors to make donations, contact the Foundation, subscribe to updates, or access third-party resources.
The Site is provided for general informational and charitable purposes only. We may change, suspend, or discontinue any part of the Site at any time.
2. Not Medical, Clinical, Legal, or Professional Advice
The Site does not provide medical advice, diagnosis, treatment, clinical-trial advice, legal advice, or other professional advice. Information on the Site should not be used as a substitute for advice from qualified medical, legal, tax, financial, or other professional advisers.
If the Site includes information about disease areas, research, care resources, clinical trials, or third-party programs, that information is general in nature and may not be complete, current, or applicable to any individual. Always consult qualified professionals before making health, treatment, research-participation, legal, tax, or financial decisions.
The Site is not intended for medical emergencies. If you believe you may be experiencing a medical emergency, call 911 or seek emergency medical care immediately.
3. No Research Consent or Clinical Trial Enrollment
Nothing on the Site is a clinical trial informed consent, HIPAA authorization, IRB-approved research notice, research participation agreement, or guarantee of eligibility for any study, trial, registry, service, grant, or program.
Any clinical trial, research registry, patient support, grant, or other specialized program may be subject to separate eligibility criteria, consents, privacy notices, terms, institutional requirements, sponsor requirements, or regulatory rules.
4. Donations and Payments
If you make a donation through the Site, you agree to provide accurate information and authorize the applicable donation processor or payment processor to process the transaction. Payment processing may be handled by third-party service providers, and their separate terms and privacy practices may apply.
Unless otherwise stated at the time of donation or required by law, donations are generally non-refundable. The Foundation may decline, return, or restrict a donation where appropriate, including where required for legal, compliance, reputational, operational, or mission-related reasons.
The Foundation is recognized by the Internal Revenue Service as tax-exempt under Section 501(c)(3) of the Internal Revenue Code. Donations may be tax-deductible to the extent permitted by law. Donors should consult their own tax advisers.
5. Ownership of Site Content
Unless otherwise indicated, the Site and its content, including text, graphics, logos, photographs, videos, audio, design, layout, software, and other materials (collectively, “Content”), are owned by or licensed to the Foundation and are protected by intellectual property and other laws.
You may access and use the Site and Content for personal, informational, and non-commercial purposes related to the Foundation’s mission. You may not copy, modify, distribute, display, perform, publish, create derivative works from, or exploit the Site or Content except as permitted by these Terms, with our prior written permission, or as otherwise allowed by law.
6. Trademarks
The Foundation name, logos, marks, and related branding are trademarks or service marks of the Foundation or its licensors. You may not use them without prior written permission, including in any manner that suggests endorsement, sponsorship, affiliation, or approval.
7. Your Submissions
If you submit information, comments, stories, photographs, videos, feedback, suggestions, or other materials to the Foundation through the Site or by other online means (“Submissions”), you are responsible for your Submissions and represent that you have the rights needed to provide them.
Unless we enter into a separate written agreement with you, you grant the Foundation a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, display, distribute, and otherwise use your Submissions for Foundation operations, communications, fundraising, education, and mission-related purposes. We will use personal information in accordance with our Privacy Policy and any additional consent terms presented to you.
Do not submit confidential, proprietary, sensitive health, patient, research, or third-party personal information unless we specifically request it through an appropriate channel with applicable notices and consents.
8. Prohibited Uses
You may not use the Site to: (a) violate any law or regulation; (b) infringe or misappropriate intellectual property, privacy, publicity, or other rights; (c) submit false, misleading, unlawful, defamatory, harassing, abusive, obscene, or harmful content; (d) interfere with the security, integrity, or operation of the Site; (e) attempt to gain unauthorized access to systems or data; (f) introduce malware, scraping tools, bots, or other harmful or automated processes except as permitted by law; (g) impersonate any person or entity; or (h) use the Site in a way that could harm the Foundation, other users, donors, partners, or the public.
9. Third-Party Links and Services
The Site may link to or integrate third-party websites, platforms, donation processors, payment processors, social media services, clinical trial resources, research resources, or other external services. Those third parties are independent from the Foundation. We do not control and are not responsible for their content, availability, security, terms, privacy practices, or actions.
Links to third-party resources do not necessarily mean that the Foundation endorses, sponsors, or verifies those resources.
10. Privacy
Our Privacy Policy describes how we collect, use, disclose, and protect personal information in connection with the Site. By using the Site, you acknowledge that personal information will be handled as described in the Privacy Policy and any other applicable notices.
11. Disclaimers
The Site and Content are provided “as is” and “as available.” To the fullest extent permitted by law, the Foundation disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of accuracy, completeness, reliability, availability, non-infringement, merchantability, and fitness for a particular purpose.
We do not warrant that the Site will be uninterrupted, secure, error-free, free of viruses or other harmful components, or that any defects will be corrected. We do not warrant that information on the Site is complete, current, or suitable for any particular purpose.
12. Limitation of Liability
To the fullest extent permitted by law, the Foundation and its directors, officers, employees, volunteers, agents, representatives, licensors, service providers, and partners will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or use, arising out of or related to the Site or these Terms, even if advised of the possibility of such damages.
To the fullest extent permitted by law, the Foundation’s aggregate liability for claims arising out of or related to the Site or these Terms will not exceed the greater of one hundred U.S. dollars ($100) or the amount you paid directly to the Foundation through the Site in the twelve months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above limitations may not apply to you.
13. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the Foundation and its directors, officers, employees, volunteers, agents, representatives, licensors, service providers, and partners from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Site, your Submissions, your violation of these Terms, or your violation of any law or third-party right.
14. Changes to These Terms
We may update these Terms from time to time. The updated Terms will be posted on the Site with a revised effective date. Your continued use of the Site after the updated Terms are posted means you accept the updated Terms.
15. Termination or Restriction of Access
We may suspend, restrict, or terminate access to the Site at any time, with or without notice, including if we believe your use violates these Terms, creates risk, or is inconsistent with the Foundation’s mission or operations.
16. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Subject to applicable law, any dispute arising out of or related to the Site or these Terms will be brought in the state or federal courts located in San Francisco County, CA, and you consent to the jurisdiction and venue of those courts.
Confirm the Foundation’s preferred governing law, venue, and dispute-resolution position before publication.
17. Miscellaneous
These Terms, together with the Privacy Policy and any additional terms presented for specific features or programs, are the entire agreement between you and the Foundation regarding the Site. If any provision is held invalid or unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver of that provision. You may not assign these Terms without our prior written consent. The Foundation may assign these Terms as part of a reorganization, merger, transfer, or other change involving the Site or Foundation operations.
